These Terms of Service ("Terms") govern your access to and use of the website located at https://mcapipeworks.com (the "Site"). The Site is operated by MCA Pipeworks, an owner-operated residential plumbing business based in Long Beach, California, owned and operated by Mondyko Aubry. In these Terms, "we," "us," and "our" refer to MCA Pipeworks, and "you" and "your" refer to you, the person accessing or using the Site. Please read these Terms carefully. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree with these Terms, please do not use the Site.

By accessing, browsing, or otherwise using the Site, including by submitting our "Request Service" contact form, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. These Terms apply to all visitors and users of the Site.
If you do not agree to these Terms, you must not access or use the Site. We may update or change these Terms from time to time as described in the "Changes to These Terms" section below, and your continued use of the Site after any such change constitutes your acceptance of the revised Terms.
Informational Site and Non-Binding Estimates
The Site is a marketing and informational website only. It is intended to provide general information about our residential plumbing services and to allow you to request that we contact you. The Site does not support online accounts, online payments, or any form of electronic commerce.
Any pricing, rates, sample costs, "starting at" figures, or estimates that may appear on the Site are general and provided for informational purposes only. They are illustrative, non-binding, and subject to change without notice, and they do not constitute a binding quote, an offer, or a guarantee of any particular price. No contract for plumbing work is formed through the Site.
Your submission of the "Request Service" form is a request to be contacted only. It is not a booking, an appointment, or a binding agreement, and it creates no obligation on either you or us until and unless we reach a separate written estimate or agreement. All actual plumbing work will be performed only under a separate written agreement or estimate, consistent with applicable California law.
No Professional Advice Through the Site
Any plumbing information, tips, articles, or other content provided on the Site is general in nature and is offered for informational purposes only. It is not professional, diagnostic, or safety advice tailored to your specific situation, and you should not rely on it as a substitute for the judgment of a licensed professional who has evaluated your particular circumstances.
Do not rely on the Site for guidance in an emergency. If you are facing a gas leak, sewage backup, flooding, or any other hazardous condition, contact a licensed professional, contact us directly, or call your local emergency services as appropriate. We are not responsible for any action you take or fail to take based on information found on the Site.
Site Provided "As Is" and No Warranties
The Site and all content on it are provided on an "as is" and "as available" basis. To the maximum extent permitted by California law, we disclaim all warranties of any kind with respect to the Site, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error free, secure, or free of viruses or other harmful components, or that any defects will be corrected. This disclaimer applies only to the Site itself. It does not apply to, limit, or waive any warranty relating to plumbing work we may perform for you, which is governed by your separate written service agreement and by applicable California consumer and contractor law.
Accuracy of Information
We try to keep the information on the Site current and accurate, but the Site may contain typographical errors, inaccuracies, omissions, or information that is out of date, including with respect to descriptions of services, availability, and any pricing references.
We reserve the right to correct, change, or update any content on the Site at any time without prior notice. We are not liable for any reliance you place on uncorrected errors or on information that has since been changed or removed.
Intellectual Property
Unless otherwise noted, all content on the Site, including text, graphics, logos, photographs, layouts, and the "MCA Pipeworks" name and branding, is owned by or licensed to us and is protected by applicable intellectual property laws.
We grant you a limited, personal, non-commercial license to view and access the Site for the purpose of learning about and requesting our services. You may not copy, reproduce, republish, distribute, scrape, harvest, modify, or otherwise reuse any content from the Site without our prior written permission. Trademarks, service marks, logos, and other proprietary materials of third parties that may appear on the Site, including those associated with Google Maps, are the property of their respective owners and are used subject to their own terms.
Acceptable Use
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You are responsible for your use of the Site and for any information you submit through it.
When using the Site, you agree that you will not:
- Use the Site in any way that violates any applicable federal, state, local, or other law or regulation;
- Interfere with, disrupt, or place an unreasonable load on the Site or the servers or networks that support it;
- Use any robot, spider, scraper, or other automated means to access, harvest, or collect data from the Site without our permission;
- Submit false, misleading, or fraudulent information, or submit another person's information through the contact form without that person's consent;
- Introduce any virus, malware, or other harmful code, or attempt to gain unauthorized access to any part of the Site or its underlying systems.
Third-Party Links and Services
The Site embeds and relies on certain third-party services. In particular, the Site uses the Google Maps Platform (Google Maps JavaScript API) to display service-area maps, and the Site is hosted and delivered through Cloudflare, which provides hosting, content delivery, and security services. The Site may also contain links to websites or resources operated by third parties.
These third-party services and websites are governed by their own terms of service and privacy policies, and they are not under our control. We do not endorse and are not responsible for the content, products, services, availability, or privacy practices of any third party. Your use of any third-party service or website is at your own risk and subject to that third party's terms. Your use of the Google Maps feature is subject to the Google Terms of Service, available at https://policies.google.com/terms.
Limitation of Liability
To the maximum extent permitted by California law, in no event will we, or our owner, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. To the maximum extent permitted by California law, our total liability for any claim arising out of or relating to the Site will not exceed one hundred dollars ($100).
This limitation applies to liability arising from your use of the Site and is separate from any liability arising out of plumbing services we may provide, which is governed by your separate written service agreement and applicable contractor and consumer protection law.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under California law. For example, under California Civil Code Section 1668, we do not attempt to exempt ourselves from liability for our own fraud, willful injury to the person or property of another, or violation of law, whether willful or negligent. Nothing in these Terms limits liability for personal injury caused by our gross negligence to the extent such limitation is prohibited by law.
Indemnification
You agree to indemnify, defend, and hold harmless MCA Pipeworks and its owner from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any applicable law or the rights of any third party in connection with your use of the Site.
Governing Law and Venue
These Terms and any dispute arising out of or relating to these Terms or your use of the Site are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
Subject to the informal dispute resolution and small claims provisions below, you agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction and venue of those courts.
Informal Dispute Resolution and Small Claims
Before filing any claim against us arising out of or relating to these Terms or the Site, you agree to first try to resolve the dispute informally by contacting us at [email protected] or (213) 273-5810 and providing a brief description of the dispute and the relief you are seeking. We will attempt in good faith to resolve the matter. You agree to allow a period of at least thirty (30) days from the date you notify us for the parties to attempt to reach an informal resolution before either party initiates a formal proceeding.
Nothing in this section prevents either party from bringing an individual claim that qualifies in a California small claims court. The current jurisdictional limit for individual claims in California small claims court is generally twelve thousand five hundred dollars ($12,500).
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect. Where possible, an unenforceable provision will be interpreted or reformed to give effect, as nearly as lawful, to the original intent of the parties.
Entire Agreement
These Terms, together with our Privacy Policy, which is incorporated by reference, constitute the entire agreement between you and us regarding your use of the Site, and they supersede any prior understandings or agreements regarding that subject matter.
These Terms do not supersede, replace, or modify any separate written service or work agreement between you and us. In the event of a conflict between these Terms and a separate written service agreement with respect to plumbing work, the separate written service agreement controls as to that work.
Changes to These Terms
We may update or revise these Terms at any time. When we do, we will post the updated Terms on this page and update the "Effective Date" shown above. Changes are effective when posted.
Because the Site does not use accounts, we do not provide individual notice of changes. We encourage you to review these Terms periodically. Your continued use of the Site after any change to these Terms constitutes your acceptance of the revised Terms.
